Tutor LK, Terms of Service

1. Acceptance of Terms

By accessing and using Tutor LK Learning Management System ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

Tutor LK is a cloud-based Learning Management System (LMS) provided by PERCS (PVT) LTD, a company incorporated under the laws of Sri Lanka. The Service is designed for educational institutions and organizations to manage their learning processes, student data, and educational content.

3. User Responsibilities and Data Management

IMPORTANT: Data Loss Disclaimer

The Client Organization is solely responsible for:

• Backing up and securing their data
• Implementing appropriate data protection measures
• Ensuring compliance with applicable data protection laws
• Managing user access and permissions
• Training users on proper system usage

PERCS (PVT) LTD shall not be liable for any data loss, corruption, or unauthorized access to data stored within the Service.

4. Limitation of Liability

Under Sri Lankan law and to the maximum extent permitted by applicable law, PERCS (PVT) LTD:

• Shall not be liable for any direct, indirect, incidental, special, or consequential damages
• Shall not be responsible for any loss of profits, data, or business opportunities
• Shall not compensate for any losses incurred by the Client Organization
• Provides the Service "as is" without warranties of any kind

5. No Refund Policy

NO REFUNDS: All payments made for the Service are final and non-refundable.

Once payment is processed, no refunds will be provided under any circumstances, including but not limited to:

• Service discontinuation
• Change in service features
• User dissatisfaction
• Technical issues
• Data loss incidents

6. Service Availability

While we strive to maintain high service availability, PERCS (PVT) LTD does not guarantee uninterrupted access to the Service. The Service may be temporarily unavailable due to maintenance, updates, or technical issues.

7. Intellectual Property

All intellectual property rights in the Service, including but not limited to software, design, and content, remain the exclusive property of PERCS (PVT) LTD. Users may not copy, modify, or distribute any part of the Service without written permission.

8. Termination

PERCS (PVT) LTD reserves the right to terminate or suspend access to the Service at any time, with or without notice, for any reason, including violation of these terms.

9. Governing Law

These terms shall be governed by and construed in accordance with the laws of Sri Lanka. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.

10. Authentication and Third-Party Services

When enabled by your institution, you may sign in using Google OAuth or other supported identity providers. By using these options, you authorize us to receive basic profile information needed to authenticate your account. Your use of third-party services is also subject to their respective terms and policies.
